McDaniel faces Class C felony charges of aggravated assault after a Jan. 12 incident with another UT student during a pick-up basketball game at the University of Tennessee's "T-Rec'' recreation center.
If found guilty of a Class C felony, McDaniel could face a three- to six-year sentence. However, it's possible the parties could reach a settlement or the charge could be reduced to a misdemeanor. McDaniel, who is being represented by Don Bosch, could be entered into a diversion program, as well.
McDaniel is accused of striking 26-year-old Edward Goodrich and breaking four bones in his face.
According to Goodrich's affidavit, McDaniel's attack was unprovoked.
But according to sources close to the situation, law enforcement authorities have in their possession a tape of the incident. On the tape, the sources say, McDaniel is knocked to the floor by the plaintiff during the course of the game prior to the incident.
The tape likely will be used as evidence if the case goes to trial. A preliminary hearing date will set today by Judge Bob McGee.
McDaniel has been suspended indefinitely from the football team. The case will need to be reviewed by UT judicial affairs before McDaniel's playing status is determined.
McDaniel, from Columbia, S.C., hasn't had any prior disciplinary issues, according to Vols' coach Phillip Fulmer.
The 6-foot-7, 300-pounder has played in 24 games for UT, making his first and only start in the Vols' Cotton Bowl victory over Texas A&M on Jan. 1.
