The 6-foot-7, 295-pound McDaniel allegedly punched another student in the face during a pick-up basketball game at a UT recreation center on Jan. 12. He has been indefinitely suspended from the football team since the arrest.
"Tony remains suspended, and we will watch closely as the legal process runs its course," UT coach Phillip Fulmer said in a statement. "We will be fair to Tony, the university and our team."
If McDaniel is suspended from school for the fall semester or longer, it would be difficult for him to return for another season in 2006 and finish his eligibility, according to a source close to McDaniels family.
A videotape of the incident has been used to evaluate the case.
McDaniels attorney Don Bosch said hes in the process of trying to negotiate a settlement with Edward Goodrich, the student McDaniel allegedly struck.
Goodrich testified during a hearing in April that his face was broken in four places.
Bosch said a court date will likely be set within the next few weeks.
McDaniels case also is being reviewed by UT judicial affairs. The review is being done independent from the legal proceedings.
