Smith consents to plea agreement

Former Powell High School standout Lee Smith reached a plea agreement with prosecutors on a DUI charge Thursday in Knox County General Sessions Court.

Under the agreement, Smith, who was arrested by University of Tennessee police shortly before 4 a.m. on Aug. 2, will be allowed to drive on a restricted license in exchange for his guilty plea.

He must pay court costs and a $350 fine, serve 36 hours of jail time in addition to 12 hours already served and complete an alcohol assessment and education program.

Judge Bob R. McGee is expected to sign off on the plea deal today, after Smith gets a restricted license, according to a sessions court clerk.

Smith's deal is the minimum punishment for a first-time offender.

"Lee wanted to put this behind him as soon as possible," said Don Bosch, Smith's attorney. "This was the best way to do that."

The 6-foot-6, 245-pound tight end/defensive end initially committed to play football at Tennessee, but was dismissed from the team the same day as his DUI arrest.

Smith transferred to Marshall in late August, where he paid his own way for the fall semester. He will be eligible to play for the Thundering Herd next fall as a redshirt freshman.

Bosch said that Smith is "doing quite well at Marshall both academically and athletically."

In October, Smith was hospitalized and placed on respirator with breathing troubles stemming from a broken jaw suffered in what was called a "football-related" injury by Powell coach Matt Lowe.
