Under the agreement, Smith will serve 36 hours of jail time, pay a fine of $350 and undergo an alcohol evaluation and education program.
Smith was arrested on the Tennessee's campus for DUI in August.
The tight end/defensive end originally signed with Tennessee but was dismissed from the football team after his arrest.
Smith then transferred to Marshall, where he is a member of the football team.
