Fulmer's legal team looks to quash subpoena

Phillip Fulmer’s legal representatives have filed a motion in Jackson County (Ala.) Circuit Court to quash the subpoena the Tennessee football coach was served at SEC media days in Birmingham, Ala., last month.

Those representatives believe it is very unlikely that Fulmer would be forced to give a deposition in Alabama on the requested date of Sept. 25 — if he is ever forced to give a statement at all. The Vols play Auburn on Sept. 27.

“We have filed our motion which we think is appropriate,” Fulmer’s attorney, Jeff Hagood, said Wednesday. “We’ll see what happens next.”

Fulmer’s representatives are hoping that the judge presiding over the case will take into account the unusual way Fulmer was served the subpoena, which was thrown in his lap just minutes before he was to meet with hundreds of reporters.

Copies of the order were then circulated to several members of the media. Attorneys would typically go through a witness’ home state to secure such a testimony.

Fulmer is being asked to testify in the case of booster Wendell Smith’s lawsuit over an NCAA investigation of Alabama. The NCAA accused Smith of providing recruit Kenny Smith $20,000 to sign with Alabama. Wendell Smith is claiming libel and defamation and has questioned Fulmer’s role as a source in the NCAA’s investigation.

I never did get what the problem was with him testifying in court. If he has nothing to hide, there should be no problem. If he did something illegal we need to know that also.

He doesnt need to testify because anything that he says is going to be put under a microscope. If he makes a mistake, doesnt remember something correctly, etc, under sworn testimony (which is easy to do), it could be a trap. I think he's making the correct decision, and I do not understand how what he has to say affects this law suit.

Why can Alabama not live with the fact that they were paying recruits and got caught? Not a lawyer but, as I understand it, Fulmer isn't being asked to testify in court, he is being asked to give a deposition. A deposition in which Mr. Smith's attorneys will likely be given free reign to ask Fulmer anything they want in any manner they see fit under the guise of discovery.

Any of you guys who are saying Fulmer should just go ahead and testify should ask yourself if you would want to be harassed by a group of attorneys in a state where you are widely considered public enemy #1.
