The Tennessee men's basketball program could be facing four major infractions as a result of coach Bruce Pearl's actions over the past three years.
But the message from UT athletic director Mike Hamilton is clear.
"It's important for people to know that Bruce is our coach," Hamilton said Friday morning. "It's important that people know where we stand with that."
It might also be important to know that Pearl has yet to sign the new contract Hamilton said was offered to him approximately two weeks ago.
Pearl confirmed Friday that he planned to sign the new five-year deal, which would pay him $1.5 million next season and $10 million over the length of the contract.
Hamilton's and Pearl's pledges to continue working together come after a Sept. 9 letter of "notification of termination of employment agreement" from Hamilton to Pearl was made public Friday morning after UT granted a freedom of information request.
Joe DiPietro, who was introduced as UT's new president early Friday afternoon, was asked about his thoughts on Pearl's situation.
"I think the key is that athletic reporting arrangements now go through the chancellor's office where it belongs," DiPietro said. "The buck stops in the president's office.
"I think we're on the appropriate track there, and I look forward to working with Chancellor (Jimmy) Cheek and Mike Hamilton."
Cheek and Hamilton have overseen the athletic program at UT in the absence of a system president over the past 1 1/2 years.
Notification Letter
Cheek essentially signed off on the notification letter, which includes details about the Sept. 20, 2008, recruiting visit at the center of the NCAA investigation into the men's basketball program.
The letter revealed three potential major violations and the current ineligibility of UT freshman Jordan McRae.
McRae is expected to have his eligibility reinstated prior to the Vols' Nov. 12 season opener against Chattanooga in Thompson-Boling Arena, according to sources in the UT athletic department who asked not to be identified due to the sensitive nature of the investigation.
According to the Sept. 9 notification letter, which also served to cancel out Pearl's previous contract, Pearl told three high school junior recruits who visited his home on Sept. 20, 2008, that their presence constituted a NCAA violation.
McRae was one of the recruits present, along with Aaron Craft, who's now at Ohio State, and Josh Selby, who's now at Kansas.
Other recruits were visiting UT that weekend, including current Vol basketball player Skylar McBee and current Georgia football player Marlon Brown, who was being recruited to Tennessee to play both football and basketball.
But the only unofficial visitors who came to Pearl's home for the cookout with the basketball coaches and some of their family members were McRae, Selby and Craft, all of whom had already verbally committed to the Vols at that time.
It's against NCAA rules for coaches to have off-campus contact with recruits who are still juniors in high school and to provide them with food, drink and/or entertainment.
Infractions
Because Pearl knowingly committed the violation - he had a similar one at Wisconsin-Milwaukee in 2004 which was self-reported - it would be considered "major" based on NCAA precedent and previous interpretations of NCAA bylaws.
The notification letter states Pearl told the recruits he was not going to tell anyone about the off-campus visit, and he asked they not tell anyone, either.
The Sept. 20, 2008, visit became public on Sept. 10 of this year at a UT press conference involving the school's receipt of a letter of inquiry.
The letter of inquiry served the purpose of informing UT that an official NCAA investigation was under way. The investigation involves the men's basketball, football and baseball programs.
Hamilton revealed during the letter of inquiry press conference that Pearl faced the likelihood of an unethical conduct charge because he was not forthcoming in a June 14 interview with NCAA investigators.
Pearl and his assistant coaches were shown a picture of Pearl and Craft, which was taken inside of Pearl's house and had the wife of assistant coach Jason Shay in the background. They were asked if they could identify the location where the photo was taken.
Pearl said he did not know the location of the photo and told investigators he couldn't identify Shay's wife in the black-and-white shot that had been reproduced off a printer.
According to the letter of notification, Pearl also talked with his assistant coaches after they had been interviewed by the NCAA and before he went into his initial interview.
Further, the notification letter said, Pearl called the parent of one of the three prospects that was at his home Sept. 20, 2008, both before and after his June 14 interview.
A source in the UT athletic department, who asked to remain anonymous because of the ongoing nature of the investigation, said the parent Pearl called was John Craft.
Thus, the notification letter also charges Pearl with failing to protect the integrity of the NCAA investigation, which is a major violation by its nature.
Pearl requested a second interview with the NCAA, conducted on Aug. 5, in which he admitted the picture was taken at his house and the woman in the background was Shay's wife.
Another infraction chronicled in the notification letter is that Pearl "falsely certified in writing" on Sept. 8, 2009, that he had properly reported any previous violations to the appropriate UT compliance administration.
In addition to the Sept. 20, 2008, visit at the center of the investigation, UT has submitted documentation to the NCAA showing 97 impermissible phone calls that occurred between October 2007 and July 2009.
The calls were made to a number of former recruits and current players at different times and instances, and were submitted in four separate self-reports. Pearl was responsible for 34 of those calls, according to the letter of notification.
UT attributed the calls to sloppy record keeping, miscommunication between the coaches and carelessness.
Pearl and assistant coaches Tony Jones and Steve Forbes were issued letters of reprimand as a result of the calls.
In other cases involving an excess of phone calls or impermissible contacts, such as the one recently concluded at Chattanooga, the NCAA has grouped the excess calls into one major violation.
What's Next?
The NCAA notified Tennessee in its letter of inquiry that the NCAA enforcement staff plans to deliver its letter of allegations in December.
From there, UT will respond to the letter of allegations and the process will go into the summary disposition phase before likely concluding with an appearance before the NCAA's committee on infractions.
The committee on infractions will review the case and UT's self-imposed penalties before determining if further sanctions are appropriate and, if so, what those sanctions should entail.
Because of the number and the nature of violations in UT's case, it's probable Tennessee will be placed on probation in addition to the possibility of further sanctions.
Hamilton said at the letter of inquiry press conference that there also was a possibility that Pearl could be suspended by the NCAA for a year.
UT has already administered several severe and unprecedented self-imposed sanctions on the basketball program, most notably a $1.5 million reduction in Pearl's salary and an off-campus recruiting ban that Pearl and his assistants began serving on Sept. 24, 2010.

Now that the facts are known, there is only one appropriate course of action. The University of Tennessee must fire Bruce Pearl. He has given them no other choice. It doesn't matter how many games he has won. It doesn't matter what anybody thinks about the NCAA and it's rules. Pearl has knowingly violated the rules, lied about it and encouraged others to lie. His actions are irresponsible and reprehensible. The fact that he later 'fessed up' is irrelevant. Pearl has shown on multiple occasions, both personally and professionally, he cannot be trusted.
Others in places of responsibility at the University who support Pearl's untenable position must go too. That means Hamilton and Cheek. Their continued support of Pearl makes them as guilty as he is.
If the new President loves the University and has any sense of right and wrong, he must clean house. Cancer requires more than a band aid--major surgery is required now!

as a student at UT, I can honestly say I would prefer any penalty over a postseason ban. I don't know what i would do if i have to end up sitting through four years of crappy football AND basketball. Although with the elite eight last year, i understand i'm already a little bit spoiled compared to many other four year students at UT

Look at it like this, instead of taking a chance on another coach with skeletons in the closet, keep this one and hope he doesn't screw up again. At least now you know everything (you hope) and you can hold his feet to the fire.
Pearl, and the program are not accused of cheating, or doing anything illegal. No payments or illegal gifts.
This was a cookout, and phone calls, that pretty petty compared to most all other college programs. End of story.

But why do you use us every time something is wrong? You say Cal got two schools in trouble and ran. There is no proof. Rose cheated before he got to Memphis. How did Cal know he got someone to help him on SAT before he even signed with Memphis? Cal didn't get in trouble, neither did Memphis actually. The rules say the player was ineleible so wins don't count. They never said Memphis knew. Camby at UMass got gifts from boosters. Did Cal know? Maybe, maybe not. Never proven he did. Matter of fact, boosters don't want coaches to know these things. He didn't leave when the going got tough at these schools. Two more things before I close. First, I am not a basketball hater. I have a degree from UT and have enjoyed the revitalization of UT basketball--until I found out the facts about Pearl and his staff. Did these rules violations occur because Bruce knew he had to compete with the worst rules violator in John Calipari. As much as I disliked Bobby Knight, he knew how to run a clean program. I feel like the administration has to accept part of the blame since it is their responsibility to know what is going on in their athletic programs.

So Cal didn't know Derrick Rose's brother was on the team plane flights with the team did he? He didn't know Bledsoe was ineligible did he? Minor violations are acceptable and expected everywhere but major infractions are not. Get the cheating and lying labels, if true, away from the Tennessee campus. There is one glaring name that has brought disgrace and dishonor to Rocky Top and that guys initials are MH...If he were never here, much less in charge of things, CDC of Duke may have returned...I ask, why is he still AD amid the CLK and CBP fiascos..? Obviously Pearl is the best thing to happen to UT basketball in a long time. As much as I love watching him coach and hearing him speak, I have to say I am very disappointed in his attempts to cover everything up. He has said before that all eyes will be on him because of his involvement with the Illinois situation in the past. What was he thinking? Are the phone calls and the party the worst thing a coach could do - no. But outright telling players and families that he is committing a violation and asking them not to say anything thing - really??
The Vol in me hopes somehow we pull out of this and Pearl is still our coach. But the more that comes out, the harder it is to see that happening. A couple of days ago I thought all would be fine, now I'm starting to question that. Hope I'm wrong. (And if Pearl ends up going, I hope Hamilton is right behind him. Actually I hope Hamilton goes regardless!)

I think many people are missing the big picture here. I appreciate what Coach Pearl has done for this program just like everyone else. However, his track record of cheating and lying about it shows us he has some serious character flaws that need to be addressed. It's more than just saying "bad boy, don't do it again". I realize he is losing salary and recruiting priviledges, but you don't stop a cheater unless you change the character of the cheater. What is he doing to change his character? What's to keep him from cheating again in a different way? That's my question. Thats what I want to know.
Big Picture here guys, in four years from now do we want to go through another investigation that will cripple this program for many years? Regardless of whether you agree with the NCAA or not, he admitted he cheated and lied about it. You have to have character deficiencies to do that knowing the consequences if you get caught.

The fact that, we now later learn (that's gotten old) Bruce Pearl acknowledged knowing it was a violation, conspired with his staff to lie to the NCAA, and more importantly, conspired to have a 17 year-old and his parents lie along with him...well, it just all too much for me.
We now, very much later once again, learn that Coach Pearl HAS been terminated. It needs to stay that way.
Hamilton needs to go too, for participating in the conspiracy, and condoning Pearl's actions. Anyone with a brain knows Hamilton is only attempting to save his own job.
It's a sad day on the Hill. The saddest part is that these were stupid actions taken by grown men. All they had to do was say "oops, we had a cookout", take a slap on the wrist, and that would have been the end of it. Very foolish.

i am a thoroughly loyal vol fan and alumni of utk. i love pearl, but i love my alma mater more. if the university condones this type of behavior by its most visible representatives, it is acknowledging that its existence as a university is no more than an excuse for operating a collegiate athletic department. furthermore, it will have forfieted any claim to use words like 'integrity', 'honor', or 'leadership' in any of its self descriptions.

Yeah, it's ESPN and we all "know" ESPN hates UT. But facts are facts. I don't see much "opinionating" in O'Neil's report.
I don't know any more about this mess than anyone else outside of the UT and NCAA inner circles. All I know is what I read, and the goings on are starting to impact the already blemished image of my University.
Not ready to throw anyone under the bus ... yet. But it is time for Hamilton, Cheek, Pearl, and everyone else involved to come clean, 100% clean, about everything going on. This bi-weekly release of the next embarrassing chapter in this sad saga is truly making our University look foolish, ignorant, and deceitful. Although it is laudable that Hamilton and UT are standing firm behind Pearl, it's hard to understand why Pearl remains in his current position.
Let's get to the point where the only "shoe" left to drop is the NCAA report. Time to get it all out and move on.

Pearl must go and so should Hamilton. The new president needs to clean up this filthy, stinking house of horror, and soon.

I met coach Pearl and Coach Jones at a camp this summer. I have a son who will be a 5 star recruit and will sign with UT because of Bruce Pearl and Tony Jones. If coach Pearl leaves he'll be going someplace else, probably Kentucky
as that's his second choice. As a parent and a christian I understand that sometimes good people make mistakes. We are all flawed. This is an isolated incident. My son understands from this that there are consequences for your actions and if you make a mistake as we all sometimes will, you own it and learn from it and move on. I'm surprised the NCAA isn't investigating Ole Miss because of the movie the Blind Side. That's how ridiculous some of the rules are. You can't serve a junior a hotdog at your house but they are considering whether or not a kid from Europe whose expenses were paid while he played on a professional team should be eligible. I believe players from North Carolina's football program are not eligible because they got some free hotel rooms. Where do professional players stay when they travel and what is the difference. As for Coach Pearl telling parents not to tell I'm keeping records of all the violations schools are committing while persuing my son and I can tell you what coach Pearl did is nothing in comparison.
I believe we will get 2 years probation and loose a scholarship. The game announcers will mention the incident and investigation on every televised game like they did last year. This will finally blow over after the season ends.
Now sit back and watch Coach Pearl lead us to the final four and those of you wanting him fired continue to wallow in it.
